Tom Foley: Outdated policies invite a Connecticut crash

When a test pilot takes an airplane on a risky test flight, it isn't legal to bring along passengers. Not so in Connecticut politics. Gov. Dannel P. Malloy and our Democrat-controlled legislature recently passed a budget that is a reckless experiment equivalent to a test flight in a poorly designed airplane - with all of Connecticut's citizens aboard for the ride.
While the federal government and every other state recognizes the broadly held policy consensus that voters want to hold the line on taxes and reduce spending, Connecticut's political leadership is stuck in a retro-policy world reminiscent of the 1960s. During the legislative session 1960s-era dogma and political pay-offs triumphed over common sense and good policy. It isn't amusing watching Connecticut adopt policy more evocative of Havana or Caracas than Shanghai or Mumbai. We are moving backward rather than forward and Connecticut's citizens will pay a big price.
The world has come a long way since the 1960s. People actually believed then that more government would solve problems and steeply progressive income taxes would make a more equitable society. Most policymakers and voters now realize that there are limits to what government can do well and that, past a point, more government merely smothers private sector economic activity, slows income growth, and reduces private sector employment. Connecticut arrived at that point some time ago. We also now know that taxing people excessively doesn't make society more equitable, it just drives away ever-more mobile taxpayers and jobs, reducing everyone's income and opportunities.
Because politicians and voters in the 1960s believed we could tax and spend our way out of our problems, politicians saw no need to hide what they were up to. That is not the case today. Gov. Malloy and Democrats in the legislature deceptively describe their budget as "sharing sacrifice," "reducing spending," and wringing "give-backs" out of state workers. Baloney.
The facts are clear and simple. Spending in the general fund is budgeted to go up next fiscal year by over $450 million, an increase of 2.5 percent over this year. The governor's "deal" with state workers' unions includes no reduction in either the number of state workers or the overall cost of the state workforce. Gov. Malloy and the Democratic majority are closing this entire budget deficit with increased taxes amounting to more than $2.5 billion.
These big tax increases will raise Connecticut's already high cost of living. Most of the increase in taxes will fall on middle-income households. Connecticut households in 2013 will pay on average more than $2,000 more in state taxes than they did last year. With average household income at $68,000, Connecticut's middle-income families will have to again cut back spending to meet their heavy new tax burden, further hurting an already weak economy.
What will be the effect of this disastrous policy, other than the hardship and additional belt tightening imposed on Connecticut's citizens? The most damaging outcome will be an accelerating flight of our tax base and jobs. Connecticut is already unaffordable for many families and businesses. Rather than reducing the cost of living, the recently passed budget will both raise the cost of living and the cost of employing people. People and businesses that can leave the state will. Others who might have come here won't.
Connecticut has the worst job creation record in the nation. You would think that after their dismal performance creating jobs, our politicians would be reluctant to keep pursuing the same shopworn and ineffective policies. Instead, they are stepping even harder on the accelerator, like the impulsive gambler who after losing a lot of money just keeps doubling down on the same bet.
Connecticut is conspicuously alone in its "damn the torpedoes" strategy of raising taxes and doing nothing serious to rein-in spending. In New York, where Democrats also hold the governorship and control the legislature, Gov. Andrew Cuomo has pledged to reduce spending next year by 5 percent, reduce the size of the state work force by more than 10,000 people, and not raise taxes.
Like a family that lived too well in the good times, Connecticut has to adjust to current economic reality. That is why when running for governor I pledged not to raise taxes and focus instead on wisely and equitably reducing spending. This policy direction doesn't originate in ideology or politics. It is simply the right thing to do and plain enough for political leaders on both sides of the aisle to recognize most everywhere, except in Connecticut.
The current administration's failure to recognize the need for a change in direction will only dig the state into a deeper hole.
The only good news in this confounding story is that voters seem to know they are being had. The deceptive messaging isn't working. Everything in Hartford seems too clever by half. Some think the budget doesn't reflect a policy at all, but rather an odd and un-Connecticut introduction of 1930s' style "take care of your friends" urban ward politics. Whatever it is, Connecticut isn't happy. A new poll found 71 percent of voters viewed Gov. Cuomo's policies favorably, while the most recent Quinnipiac University poll showed Gov. Malloy's rating in the mid-30s.
It isn't fair that this administration is taking Connecticut's citizens for a risky ride with discredited policies perpetrated by out-of-touch politicians. If you are planning to stick around for the test flight, I suggest you fasten your seatbelt. It is going to be a bumpy ride until our leaders get in tune with the 21st century - or voters replace them with leaders who are.

     We truly need to keep Connecticut and it's residents in prayer, that things improve for all those who are currently suffering financial and other hardships due to the current state of affairs in our Nutmeg State.
     The Lord will not be mocked...by anyone...when disservice is rendered to the people via cronyism, favoritism and the pure prejudice of Progressive politics.

"An Open Letter To All Stamford Residents From MoniqueThomas Independent Party Candidate For CT State Rep From The 148th" By Reverend Barbara Sexton



Dear Stamford Residents,


As we approach the special election on Tuesday, April 12th, I find it important to more clearly clarify who I am as a candidate and what constitutes my beliefs and qualifications to represent my neighbors in the 148th District of Stamford.


It has come to my attention that my association with the principles of the tea party movement has been mischaracterized by the press and at least one of my opponents.


First and foremost, the tea party movement is just that, a movement, not a political Party. Because the principles of the tea party movement are:
· fiscal responsibility,
· personal accountability,
· constitutionally limited government,
· and allowing businesses to run on an even playing field free of crony-capitalism and over burdensome regulations

… I got involved in the movement. These principles ring true for me. I was one of four founders of a local organization of tea partiers to promote these American principles that our Founding Fathers recognized.


As I have been speaking with Republican, Unaffiliated, Democrat and Independent registered voters across the district, most agree that it is time to restore sound fiscal policy.


I believe that it is essential for elected members of our government to abide by the rules we have allowed them to ignore for decades. This is why I am asking to be the next State Representative from the 148th.


As a member of the tea party movement which encourages individual responsibility to be a leader in one’s community, over the last two years I have participated in producing educational programs on a weekly basis right here in Stamford. Some of the topics of the programs have included voter fraud detection, economic literacy, the US constitution and the role of the 10th Amendment. We also hold discussion groups relating to State and Federal legislative issues that impact the citizens of Stamford.

I am proud to have helped my fellow citizens understand the election cycle though candidate vetting sessions and candidate training classes, voter education and voter registration drives. As a result of my leadership more citizens are getting involved.


Looking at the other 4 candidates in this race, I have not seen any effort on their part to bring this sort of information to the general public. I believe I will be the best Representative that you can select on Tuesday, April 12th . While I have the endorsement of the Independent Party, my allegiance will be to my constituents and not a political party.

A hugely important date is very close, April 12th, and we are running out of time. I feel very strongly that Monique Thomas is the one who should be sent to Hartford by you, the voter of the 148th District in Glenbrook/The Cove. As an Independent, your vote for her would send a shock to the system. You can be sure Gov. Malloy, who is already counting the additional tax dollars he will take from you, is expecting a Democrat from this district who will just rubber stamp a budget that will put this state in even more debt, lower our credit rating even more, making it more costly for the state to raise money, in turn requiring even higher taxation. You can also be sure that Gov. Malloy will make a big yawn if a Republican gets elected. But if you want to wipe that tax-hungry smirk off his face, then send Monique Thomas to Hartford. Sending an Independent, and the only candidate in the district who has signed the Taxpayer Protection Pledge, will strike fear into his heart. Monique Thomas is the LAST person he wants to see.
Monique is extremely determined to fix the problems in this state. She knows more about the issues affecting Connecticut than all the other candidates combined. Sending her to Hartford will make it clear to Malloy that he needs to listen to us, the taxpayers.
So, please, weigh this carefully. Here we are the state with the highest per capita debt in the whole nation, nearly $5,000/person just to Hartford and Malloy wants you to owe even more.
Often times, in a battle, it is one person, one event, one decision that turns that battle. Monique is that person. Vote for her on April 12th.

Dear Readers:
     Here we go.  Admit it--this is the article you've been 'waiting for' and I don't blame you.  You've been 'kept in suspense' lo these many post-election days...and with good reason
     The game of 'legal roulette' some like to engage in at election time is variable in it's duration, scope and it's outcome, as we in Connecticut well know.  The fact is, sometimes...just sometimes...that old roulette wheel takes a very, very long time to come to a stop!
     So finally, here it is, the first in a series I have entitled, "AFTER THE MATH" and this is Part I.  My "AFTER THE MATH" Series will highlight and detail post-midterm election 2010 updates in Connecticut and nationwide. 
     The series will contain reporting and analysis as only I can deliver it--as a long-term member of the CHURCH behind the 'President and the Progressive-Lib Democrats(See 'SYNOD 2007' below)  Although I am no legal expert, I pray that you find it interesting, at the very least.  We'll start with this 'piece' by ART MOORE of WORLD NET DAILY.
       We live in an age where truth is fully expendable and where 'the Progressive-Lib Dem' mentality manifests every form of 'Godlessness' known to mankind.  Laws are broken with 'organized finesse', or, failing that, with 'blunt force'.  No matter...the MENTALITY is the MESSAGE!
     And we get it!  We, in Connecticut, as in other states, have seen the PROGRESSIVE-LIB DEM MENTALITY run roughshod over decency on many levels.  While nationally, the TEA PARTY PATRIOTS and other Grassroots initiatives have made progress, here in the Nutmeg State we still have much work to do.
     The 'NUTMEG' is a tough nut to crack.  In fact, you can't--it must be grated on a metal grater and VIGOROUSLY at that.  And technically it's a 'FRUIT' from an evergreen species known as Myristica fragrans  (pron: meh-RIS-TEEK-ah  FRAY-grans) an evergreen tree indigenous to--like PRESIDENT OBAMA--Indonesia!

     Enough with our botany lesson.  Now read here how those of us who have worked to make certain that WE and our IMMIGRANT LOVED ONES are LEGAL have been run 'roughshod over' by the LEFTAside from the LEGALITIES, I ask you, "How UNCONSCIONABLE is it for a political MACHINE to subjugate, enslave and exploit an entire group of people--illegal ALIENS?
     Who are these ILLEGALS issued ID cards in CONNECTICUT?  Are they innocent victims simply seeking a better life in America and willing to break the law to do so?  Or are they 'running from something' in their native country?  Maybe they're TERRORISTS who are using the LEFT THEMSELVES and are here with the sole intention of doing harm?
     The Republicans, some 'good' Democrats and unaffiliated voters sure would like to know, even if others don't.

Connecticut's lame-duck attorney general and new senator-elect, Richard Blumenthal, is obligated to investigate credible accusations of voter fraud that linger in the state's gubernatorial election – including possible illegal alien voting – despite Republican candidate Tom Foley's concession yesterday to Democratic opponent Dannel Malloy, charges the GOP's attorney general candidate in last Tuesday's election, Martha Dean


Dean, who is considering further legal action challenging the eligibility of her victorious Democratic opponent, argued Blumenthal is sworn to uphold the federal and state constitutions, making it his obligation to investigate voter fraud "without regard to whether it has been requested or approved by the secretary of state."


Foley supports continued investigation of the allegations but has concluded "there was no credible evidence of fraudulent voting" that would have altered the result.


Allegations include extended voting hours in Democratic-stronghold Bridgeport announced illegally through the reverse 911 system, unattended bags of ballots, ballots photocopied without supervision and union workers leaving replica ballots in polling booths with Democratic candidates checked off.


Republicans cried foul last week after the state's top election official – Democratic Secretary of State Susan Bysiewicz – declared the Democratic candidate the winner despite the absence of an official vote count and a post-deadline tally from Bridgeport that overcame the Republican candidate's lead.


But amid the numerous reported allegations, little has been said about the possibility that illegal aliens decided a gubernatorial race in which the candidates officially were separated by just 5,810 votes out of more than 1 million cast, Dean told WND.


Dean noted that both the mayors of New Haven and Hartford have declared their cities "sanctuary cities" for illegal aliens. She pointed out that over the past three years, New Haven has issued ID cards to about 15,000 people, ostensibly to enable them to use public services such as the library....

There are "sister" parties to the New York WFP in Connecticut, Massachusetts, South Carolina, Delaware, Vermont and Oregon, but there is as yet no national WFP. "Bridgeport's Registrars of Voters 2010 Mid-Term Election Shame" By Reverend Barbara Sexton

Dear Ones:
     I have been praying for Connecticut, for we 'the electorate' and for TOM FOLEY and DANNEL MALLOY
     I have also been praying for ELECTION OFFICIALS--both those who have conducted themselves in an HONORABLE manner...and for those who HAVE NOT.  Specifically I am praying for Joseph Borges and ''Sandi' Ayala, may God have mercy on them for what they have brought upon us all.
     I know I am not alone.  I'm sure many people of good faith EVERYWHERE are joining me in petitioning God for relief from an untenable situation.  If ever a secular situation warranted intense prayer, this is it.
     Not only the entire country, but the WORLD is watching the current scenario 'unfold' with all it's incompetents and their absurdities and gross irregularities.
     We here in Connecticut...and in BRIDGEPORT in particular...are the laughing stock of all good people who not only 'believe in', but honor 'GOOD VOTING PRACTICES' while adhering to the 'letter of the law'.
     Not so in Connecticut.  I know we are a 'PROGRESSIVE LIB-DEM' state, but the situation resulting from our latest election is absurdStill, I might just use this as a 'TEACHABLE MOMENT'. 
     I don't actually like that phrase, a 'TEACHABLE MOMENT', now so ingrained into the American lexicon by the very Progressive-Lib Dems who seem now to be at the epicenter of Connecticut's MASSIVE ELECTION DEBACLEIn fact, the term has been way overused.
     But, alas, the term seems apt.
     And so I am taking this opportunity to provide some Pastoral advice for those I have supported, lo these many months--for  TOM FOLEY, MARK BOUGHTON and their TEAM.
     My advice--no matter what the outcome of the Governor's race--is this:  I would ask them to 'do and say' as Joseph of the Bible did.  Joseph, as we all remember, was sold to Pharaoh into slavery by his very own brothers.
     It took the tragedy of their own father's death to bring the brothers together once again.  This is again an 'apt analogy', as we in Connecticut experience the TRAGEDY of a voting experience gone completely 'awry'.
     We need to have 'our choices Tom and Mark' do as Joseph did, which is to be as forgiving as they are wise. 
     Joseph tells the traitorous brothers who betrayed and sold him a very simple truth, "You intended to harm me, but God intended it for good..." Genesis 50:20  (NIV)
     Similarly, I'd like to see TEAM FOLEY-BOUGHTON....whether they WIN or LOSE...look at those who have worked against them squarely in the eye.  
     Let those who have PRETENDED to be part of a 'supportive' and 'fair' electoral system and PRETENDED to be 'the honorable opposition' hear what Tom and Mark have to say.
     Win or lose, I would have TEAM FOLEY-BOUGHTON speak and live these words of Joseph with all sincerity and good-intention. (highlighted below) 
"15 When Joseph’s brothers saw that their father was dead, they said, “What if Joseph holds a grudge against us and pays us back for all the wrongs we did to him?” 16 So they sent word to Joseph, saying, “Your father left these instructions before he died: 17 ‘This is what you are to say to Joseph: I ask you to forgive your brothers the sins and the wrongs they committed in treating you so badly.’ Now please forgive the sins of the servants of the God of your father.” When their message came to him, Joseph wept.

     I am so sorry for all of us having to go through this in Connecticut.  It's sad and it's wrong
     But I feel assured that through TOM FOLEY and MARK BOUGHTON, much 'good' will come of this.

I am praying that 'GOOD CONNECTICUT DEMOCRATS' step up to the plate and defend TRUTH & HONESTY in the recent MID-TERM ELECTIONS. 

Surely some CT Dems ARE NOT going to DEFEND VOTER FRAUD...are they?  Surely some 'GOOD' Connecticut Democrats WILL fight against VOTER FRAUD as it is uncovered, WON'T THEY?

Surely some RIGHTEOUS CT DEMOCRATS will wish to know that their (our) Governor was DULY ELECTED...Right?  Isn't that what we ALL want?

Surely NANCY DINARDO, CHAIRWOMAN of The CONNECTICUT DEMOCRATIC PARTY is 'exquisitely interested' in getting to the bottom of the Connecticut Gubernatorial race brouhaha with it's growing allegations of VOTER FRAUD having been perpetuated by DEMS (allegedly, of course)...........ISN'T SHE?

NANCY D. where are you?  This PROUD TEA PARTY PATRIOT sure would like to KNOW!  We should keep those who respect God and man's law (imperfect though the latter is) in STRONG PRAYER at this time in Connecticut's history.

It's too bad that 'The Nutmeg State' has been a 'hub' of major Progressive-Lib Dem 'machinations' for many years now.

Lord God, we come to you in our desperate time of need.  We know that you love Truth and protect those who love You and your Truth.


We are at a time now when others make us their 'enemies', when we are not.


We are at a time now when human politics is largely caught up in the web of life without You, our Creator, as people become boasters and do and say things without considering the consequences of their words and actions.


We have been down-trodden and wrongly accused.  Our leaders have been wrongly scandalized and 'smeared'.  Won't you help us now, O Lord?


Our faith in You is strong, Dear Father, and is growing in those who 'doubt somewhat', as we come together seeking Your Guidance and Favor.


In this endeavor, we seek to provide all Connecticut residents with a good and fair and decent standard of life. 


Surely You will shower your Mercy on us, your poor servants, who want nothing more than to discharge the duties you inspired in us in the first place.


Lord God, please continue to instill in Connecticut's Team Foley-Boughton campaign a strong sense of purpose, determination, commraderie and steadfastness. 


And we turn to You for perseverence and for the strength-of-will 'to be of good cheer'.

"Malloy's Insider Misery: CT Dems Totally Split This Year About Him & Many Issues"

        Poor Dan Malloy.  He's taken to 'ripping' into his fellow Democrats.  READ HERE:

     Can we BLAME MALLOY?  No, actually, for not 'one' but 'many little birdies' have confided in this 'political-neophyte', yours truly.  And what 'they're saying' is that THE DEMOCRATIC PARTY IS SPLIT BUT GOOD...And with GOOD REASON.
     Is it ME or is it....'unFUTUREGOVERNORLY' for a gubernatorial candidate to put forth the following?:
"The hypocrisy here is stunning," said Malloy. "Carl Feen is the consummate 'insider' - he raised money for candidates and bragged about his connections to them, while using state government to rip off taxpayers and pocket close to $500,000 in the process. Tom Foley is touting the endorsement of someone who took money out of the pockets of hard-working people in this state, and my running mate, Nancy Wyman, is actually the person who led the charge to force Cigna to put that money back into state coffers. If providing new leadership and a break from the status quo really is so important to Tom, then he must immediately renounce Carl Feen's endorsement, who certainly represents none of those qualities.''
     My oh my oh my oh my! All this name-calling, naming and claims of illegalities! Dannel sounds like the 'nosey neighbor' leaning over the yard fence gabbing-it-up with the latest nasty gossip! 
     But this is no casual backyard conversation and I sure hope that Dannel Malloy and his people  can BACK all their allegations UP!  This is serious STUFF!
    And what's with all this 'insider talk', anyway?  Based on all the alleged 'insider law fees' between 'the Malloy camp' and Andrew McDonald, we've no doubt Dan is well-versed in 'insider issues'.  And those of us left in Stamford are left 'suffering' with those legal bills...not that Dan or any of his supporters gives a hoot...
     But more importantly, isn't it just a tad...'UNFUTUREGOVERNORLY' for Malloy to be speaking as he does ABOVE?  I think so.  For Pete's sake, doesn't the Malloy Campaign have some POLITICAL LACKEY they can call upon to do this 'dirty work' for them?  Is it just that Malloy cannot HELP HIMSELF, at this point?  I don't know! 
     But Dannel Malloy's continual 'naming of names' and details and alleged 'illegalitites' seems so...I don't know...petty and out of place.  Can't Dan's campaign amass the FACTS on the ISSUES and RELEASE them? And shouldn't illegalities be better studied in a COURT OF LAW?
     (I should be careful about what I wish for, considering the MASSIVE LEGACY of OUTSIDER LEGAL FEE WE CITIZENS OF STAMFORD NOW OWN THANKS TO THOSE WHO SUPPORT DANNEL MALLOY!, but still.....)
      I'm guessing the Malloy campaign cannot do any of the above and prefers to do the 'down and dirty politics' of old.  They seem to not be able to resist the netherworld of this election cycle for some reason, probably because they are scared stiff with Dan being the biggest 'scaredy-cat' of all.
       The intense PRESSURE  Progressive-Lib Dems are feeling must REALLY, REALLY be a concern to Dan at this point, considering how close in the polls  MY FAVORITE CANDIDATE for CT GOVERNOR, TOM FOLEY, is.  I know your camp is concerned and I feel for you, Dan, wherever you are today ripping into your fellow Democrats.  I FEEL for you!
       But I want to be PROUD of my state Governor, the way he speaks, what he speaks of and most of all, how he keeps a steady-eye on fairness, legality, equity and TRANSPARENCY in all matters.  And I want my Governor to know how to delegate. 
     The ability to 'delegate' is most definitely the sign of a 'good leader', don't you think?

Born in Italy, raised in Connecticut and eager to bring Common Sense back to CT. Hi, my name is Phil Balestriere and I am running for State Representative in District 148, Cove and Glenbrook area. Our government and their bureaucracy need to step aside and let the free markets work as they have successfully for over 200 years. Take the fiscally irresponsible elected officials’ credit card away. Tax payers are fed up with their wasteful spending. The state should spend only what it takes in, borrow only what it can pay back and if it’s broken, get rid of it. This is pure common sense.

Career politicians need to step down. Business owners, like me that know how to balance a budget, will not pass legislation that will roadblock common sense. Layers of bureaucracy that have put a hurting on Connecticut will be streamlined.

You can’t balance the budget until we balance legislature.

I have signed the Republican Party Common Sense Commitment to CT. And most importantly, I have signed the Commitment for CT offered to all candidates across CT.      I can see that POLITICS for some is a VERY NASTY BUSINESS.  I feel sorry for 'everyday people' who vote for candidates 'blindly'.  How on earth can any of us know what a candidate is really 'worth'?
     We've 'reaped what we've sown' in the past but it's time to SET THINGS RIGHT!
     Not only have I become 'politically active', but I've taken the time to really get to know the candidates that I am endorsing.  MARTHA DEAN is without doubt a fine individual who just happens to be brilliant intellectually, an expert-at-law and who has the substance and INTEGRITY others appear NOT to have!
     Please support MARTHA DEAN for CT AG-"Out with the old and in with the new!"  George Jepsen is part of the 'old guard' in CT like Nancy Pelosi and Harry Reid are the 'old guard' in D.C. and THEY ALL GOTTA GO!
     A vote for Martha will be 'change' you really CAN believe in, because she is a person you can believe in--without the b.s. and hype of candidates like George Jepsen who won't even do a simple disclosure.

Dear Friends and Supporters,

This is a statement from Clare Kindall, Jepson’s Campaign Manager following today’s court appearance:

“Dean’s suit is a …….. political attack and George has repeatedly offered his extensive legal credentials; which includes over 26 years of representing clients from probate and Superior Courts to the Connecticut Supreme Court.”

This is clearly a misrepresentation of the truth. Here is the real truth in a reply by Martha to the Courant’s Editorial this morning October 29, 2010:

The Democratic candidate for Attorney General, George Jepsen, has claimed publicly for months: “I am not a litigator,” “I am not a litigator by training or nature,” and “I do not have a litigation background.” These statements are on video and transcripts.

Last Friday’s Supreme Court ruling in the Bysiewicz case now makes clear that to be eligible for AG a lawyer must have no less than ten years of experience actively litigating in court and trying cases and that this must have been the lawyer’s primary means of earning a living.

Now, after the Court’s decision, Mr. Jepsen suddenly claims he is a litigator. What are the voters supposed to believe? Why won’t Jepson provide the names, docket numbers, etc. of cases that he personally litigated or tried? Couldn’t his prompt disclosure have averted a lawsuit to force him to show he’s eligible?

Connecticut needs an attorney general who is a zealous and effective advocate in court. The voters have a right to know that the candidates on the ballot in the AG’s race are eligible to serve. If Jepsen must be disqualified later, an AG would be appointed by the Governor. The voters deserve the right to choose.

And also here in an Op-ed piece to the CT Law Tribune addressed primarily to Lawyers:

Most of you already know that I am a skilled and experienced attorney who is not beholden to partisan politics or special interests. I have not run negative campaign ads, I declined to take ¾ of a million dollars of taxpayer money for my campaign, and I view litigation as a tool of last resort. So you must be wondering why I sued my opponent this week over eligibility.

You wonder, if Jepsen is unqualified shouldn’t I have raised this earlier? I agree that I should raise such critical issues as early as possible, and I did that. Let me explain. On a personal level I believe an attorney general candidate should be experienced litigating for obvious reasons: the job of the attorney general is to advocate for the State’s interests in court, hire and fire, train and manage 200 litigating attorneys, and be the final decision-maker on whether a case has merit or is frivolous. But my personal belief is not a legal standard; how the candidates stacked up was simply an issue for the voters.

Last Friday, however, the Connecticut Supreme Court issued its written decision in the Bysiewicz case. Unlike the oral ruling in this case, the written decision explains in detail the eligibility criteria for attorney general. The Court makes clear that 10 years of active practice at the bar does not mean 10 years of being a lawyer. Clearly Ms. Bysiewicz and Mr. Jepsen have been lawyers for more than ten years. The Court held that “active practice at the bar” means 10 years of active legal practice that includes actually litigating cases on behalf of clients in court as the principal means of earning a living and some experience trying cases before a judge or jury, as well as having the practical ability, through admissions to the various courts, to appear in the courts in which Connecticut has legal business.

Mr. Jepsen has stated for months in debates, in editorial board interviews, and elsewhere: “I am not a litigator,” “I do not have a litigation background,” and “I am not a litigator by training or nature.” So, it seemed critical to ask Mr. Jepsen at the first opportunity after last Friday’s decision whether he has the requisite experience. I did this early on the Monday morning after the Friday court decision. Mr. Jepsen did not provide information supporting his eligibility that would pass even a straight-face test ( he said on a few occasions he has been to small claims court, probate court, etc. and his name appears ‘on the brief’ on three Supreme Court cases). Mr. Jepsen provided no names of cases, docket numbers, years litigated, names of associated courts, etc. Mr. Jepsen confirmed that he is not admitted to the U.S. 2nd Circuit Court of Appeals or to the U.S. Supreme Court. This can be corrected, but it is evidence that he has not practiced in the federal appeals courts. In fact, Mr. Jepsen only filed his papers for admission to the lower federal court last year – 25 years into his career. Despite this, we cannot locate any case in federal court that he has handled. It was only because Mr. Jepsen did not provide evidence that he is eligible, and has stated repeatedly that he is not a litigator, that it was necessary to file suit.

Why was it necessary to sue before the election? If Mr. Jepsen’s eligibility were raised after the election (if Jepsen won), the new Governor would appoint the attorney general and the voters would be denied the right to choose. This outcome would also deny me (if I were to lose) the opportunity to be selected by the voters at the ballot box while matched up against a fellow litigating-lawyer, who would presumably have less name recognition than a career politician.

The voters of Connecticut deserve to have this issue resolved before the election so they know that they are choosing between candidates who have the many years of litigating experience that the Supreme Court says is necessary to effectively and zealously advocate for Connecticut’s interests.
